Terms of Use

Welcome to Custro.com (the "Website"). The website is operated by Custro, registered at Admonit HaChoresh 13, Sderot, Israel (the "Company" or "Website Management").

Use of the website, the content, products and services offered on it (the "Services") is subject to your full acceptance of the terms of use detailed below (the "Terms"). Please read the terms carefully, as any browsing, use or purchase on the website constitutes express and unconditional consent to its terms.

1. General

Binding Agreement

These terms constitute a binding legal agreement between the user ("User" or "Customer") and the Company. The provisions of the terms shall apply to any use of the website and to any purchase made through it.

Gender Clause

The terms are written in the masculine for convenience only, and refer to both women and men equally.

Right to Change Terms

The Company reserves the right to change the terms from time to time, at its sole discretion, without the need for prior notice. The binding and determinative version of the terms is the version published on the website at the time of use or purchase.

Applicability

The terms of use of the website apply to use of the website and the services included in it through any computer or other communication device (such as cellular phones, handheld computers, etc.).

2. Transaction Eligibility

Legal Capacity

The user declares and undertakes that they are eligible to perform binding legal actions. If the user is a minor (under 18) or not entitled to perform legal actions without the approval of a guardian, the use of the website shall be considered as having received the guardian's approval.

Identification Requirements

The user holds a valid Israeli identity card or valid foreign passport, and a valid credit card issued in Israel or abroad by one of the recognized credit card companies.

Email Requirement

The user is the owner of an active email inbox on the internet.

3. Services & Orders Policy

Digital Services

The website offers digital services for building, editing and designing resumes (SaaS), as well as related content services.

Information Accuracy

The Company makes efforts to ensure that the information displayed on the website is the most accurate and complete, but inaccuracies or errors may appear in good faith. The Company shall not bear any responsibility arising from or related to them.

Order Requirements

Placing an order on the website requires providing basic identifying details (name, address, email, phone). Providing false details is a criminal offense and the Company reserves its right to take legal action against those who provide false details.

Payment Approval

Transaction approval is contingent on approval from the credit card company. If approval is not received, a notification will be sent to the user and the order will be canceled.

4. Pricing & Payments

Pricing

Prices on the website are denominated in New Israeli Shekels and include VAT as required by law, unless explicitly stated otherwise.

Price Updates

The Company may update service prices from time to time without prior notice. The binding price is the price provided to the customer at the time of completing the ordering process.

Secure Payment

Payment is made through a secure payment processing system that meets the PCI-DSS standard. Credit card details are not stored on the Company's servers.

5. Cancellation & Refund Policy

This policy is subject to the provisions of the Consumer Protection Law, 5741-1981 (the "Law") and the Consumer Protection Regulations (Transaction Cancellation), 5771-2010 (the "Regulations"). In any case of contradiction between the provisions of these terms and the provisions of the Law, the provisions of the Law shall prevail.

Standard Cancellation

A user who purchases a subscription to the website's services (ongoing transaction) or a one-time service may cancel the transaction within 14 days from the date of the transaction or from the date of receiving the disclosure document containing the transaction details, whichever is later, whether or not the service has begun.

Special Populations (Amendment 47)

A consumer who is a person with a disability, a senior citizen (over 65) or a new immigrant may cancel the transaction within four months from the date of the transaction or from the date of receiving the disclosure document, provided that the agreement included a conversation between the business and the consumer. The Company may require the consumer to present a certificate proving their belonging to one of these populations.

Cancellation Fees

In case of cancellation not due to a defect, non-conformity, or breach of contract by the Company ("cancellation due to regret"), the Company may charge cancellation fees of 5% of the transaction price or NIS 100, whichever is lower. Additionally, if the transaction was made by credit card and the Company was charged a processing fee for the cancellation, the Company may charge the consumer this fee as well.

Cancellation Due to Defect

In case of cancellation due to a defect in the service, non-conformity between the service and the details provided, or failure to provide the service on time, no cancellation fees will be charged, and the Company will refund the consumer's full payment within 14 days from receipt of the cancellation notice.

Digital Content Exception

In accordance with Regulation 6(a)(7), the right of cancellation shall not apply to "information" as defined in the Computers Law, 5755-1995. Therefore, for purchases of digital products for immediate download (such as template files, digital guides) that are "information" and not an ongoing service, cancellation will not be possible after the download or file delivery, unless the product is found to be defective. For subscription services (SaaS), the right of cancellation as detailed in the Standard Cancellation section above shall apply.

How to Submit a Cancellation Notice

A cancellation notice may be submitted by the consumer through: the website via the dedicated "Cancel Transaction" link; by email to Custro.dev@gmail.com; by phone at 058-627-8755 (Sun-Thu 09:00-18:00); or by registered mail to Admonit HaChoresh 13, Sderot, Israel. The notice must include the consumer's name and ID number.

Stopping Ongoing Charges

When canceling an ongoing transaction (subscription), the Company will stop the charge at the time of receiving the cancellation notice, or at a later date if specified by the consumer. The charge will be stopped within 3 business days (or 6 business days if sent by registered mail). The consumer will pay the proportional consideration for the service provided until the cancellation date.

6. Liability & Limitations

Service 'As Is'

The services on the website are provided as is ("AS IS"). The Company shall not be responsible for the suitability of the services to the user's specific needs.

Service Availability

The Company makes efforts to maintain proper functioning of the website, but does not guarantee that the service will be immune from malfunctions, disruptions, or unauthorized access to the Company's computers, damages, breakdowns, hardware or software malfunctions, or communication line failures.

User Responsibility

The responsibility for the content of resumes, the accuracy of data and their use rests solely with the user. The Company shall not be liable for any direct or indirect damage caused to the user or to a third party as a result of using the website's services.

Limitation of Liability for Use of Artificial Intelligence (AI) Technologies and 'Hallucinations'

User Acknowledgment

The user declares that they are aware and accept that the platform and the services provided on it rely on deep integration with advanced technological models of generative artificial intelligence for writing, wording, and design. These models operate on a complex algorithmic basis of statistical prediction, and lack the ability for contextual understanding, moral judgment, or logical distinction between facts and fabrications.

AI Hallucination Risk

Therefore, it is clarified beyond any reasonable doubt that there is a real risk that texts, skills, job descriptions, or other details incorporated in resumes produced through the website will contain historical inaccuracies, material errors, false attribution of capabilities to the user, or corrupted information (a phenomenon professionally known as 'AI Hallucinations'). The outputs and services are provided to the customer 'as is' (AS IS).

User Verification Obligation

The burden of proof, verification obligation, and sole responsibility for the content rest entirely with the user. Before downloading (Download) the resume, and before presenting, transferring, or using it with potential employers, academic institutions, or any third parties, the user commits to meticulously review the document and perform rigorous proofreading to confirm the absolute accuracy of all data, dates, and statements contained therein.

Complete Liability Waiver

The Company fully disclaims, and the user releases the Company and its representatives finally and irrevocably from, all civil, tortious, or contractual liability for direct, indirect, commercial damage, loss of position, cause of action (including fraud or misrepresentation claims from an employer), reputational harm, or any other damage caused to the user or to a third party due to reliance on content that was created, distorted, or omitted by the website's artificial intelligence engine.

7. Intellectual Property

Ownership

All intellectual property rights on the website, including copyrights, designs, methods and trade secrets, are the sole property of the Company. These rights apply, among other things, to the graphic design of the website, its databases (including product listings, product descriptions, etc.), the website's computer code and any other detail related to its operation.

Usage Restrictions

It is prohibited to copy, duplicate, distribute, sell, market and translate any information from the website (including trademarks, images, texts and computer code) without obtaining the Company's explicit prior written permission.

8. Privacy & Information Security

Privacy Commitment

The Company respects the privacy of website users and considers its protection to be of great importance. The Company's privacy policy is detailed on a separate page and constitutes an integral part of these terms.

Legal Compliance

The website operates in accordance with the provisions of the Privacy Protection Law, 5741-1981, and the Privacy Protection Regulations (Information Security), 5777-2017.

Security Measures

The Company takes standard precautionary measures to maintain, as far as possible, the confidentiality of information. Credit card data transmission on the website is encrypted according to the PCI DSS standard.

9. Jurisdiction

Applicable Law

These terms and everything arising from them shall be governed exclusively by the laws of the State of Israel.

Exclusive Jurisdiction

The exclusive and sole jurisdiction in any matter and dispute arising from these terms and from the use of the website is vested in the competent courts of the Tel Aviv-Jaffa district only.
